Privacy Policy / Personal Data Processing Notice
ATS Europe S.r.l., headquartered in VERONA, Strada dell’Alpo, 20, as the Data Controller and Processor of personal data, pursuant to Articles 4 and 28 of Legislative Decree no. 196 of 30 June 2003 (Italian Privacy Code) and Articles 4, 7, and 24 of EU Regulation 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data, hereby informs you, pursuant to Articles 13 of the Italian Privacy Code and 13/14 of the EU Regulation, that it is the owner of your data and that such data will be processed in paper form and/or using IT or telematic tools, applying principles of fairness, lawfulness, and transparency, and for purposes not exceeding the objectives for which the data was collected. The processing is carried out in a manner that ensures the security and confidentiality of the data.
Purposes and Methods of Personal Data Processing
The personal data provided by the data subject (“Data”) will be processed for the following purposes:
To comply with current administrative, accounting, and tax obligations and to allow the administrative/accounting management of the company;
To fulfill obligations required by law and/or EU regulations;
To enable the invoicing of products and/or the provision of services through direct contact with the client or via the Internet;
To perform obligations arising from the contract between the parties;
To manage any complaints and disputes;
To provide access to content and news related to ATS Europe S.r.l. (“Service”), according to the methods established by ATS Europe S.r.l. (“Company and/or ATS Europe S.r.l.”);
To allow the Company to conduct surveys aimed at improving the quality of the Service provided, based on the legitimate interest of the Company, its subsidiaries and affiliates, as well as its sales network (“Customer Satisfaction”);
Subject to the data subject’s consent, to send commercial and/or promotional communications regarding the Company’s products and services, including invitations to ATS Europe S.r.l. events, and to conduct market research (“Marketing”);
Subject to the data subject’s consent, to analyze behaviors, habits, and consumption tendencies in order to improve the products and services provided by the Company, as well as to meet specific customer needs (“Profiling”);
Subject to the data subject’s consent, to share the Data with companies directly or indirectly controlled by ATS Europe S.r.l. and/or affiliated companies of ATS Europe S.r.l. (“ATS Group Companies”), which may process the data to send commercial and/or promotional communications regarding their products and services, as well as conduct market research (“ATS Europe S.r.l. Marketing”).
The processing of Data for each of the purposes listed above may take place using paper, automated, or electronic methods, that is, by any means, including, by way of example but not limited to, regular mail or email, telephone, fax, and any other communication channel (e.g., websites, mobile apps, etc.).
Mandatory or Optional Provision of Data and Consequences of Non-Submission
The provision of consent referred to in points h), i), and j) above is optional. Failure to provide such consent will make it impossible for ATS Europe S.r.l. to carry out the activities described in points h), i), and j).
With regard to the other points mentioned above, the provision of data is mandatory: without it, it is not possible to fulfill the data subject’s request. The failure to provide such data will therefore result in the inability to continue the contract or the request process.
Communication and Disclosure of Personal Data for the Pursuit of the Primary Purposes of Processing
Your personal data may be accessed by the partners, the Data Protection Officer, members, and, in any case, the persons designated by ATS Europe S.r.l. and the employees authorized to process personal data appointed by the company in the exercise of their duties.
The data will not be disclosed publicly, but they may be communicated to any other third party when such communication is required by law, including for the prevention or prosecution of any illegal activity related to access to the Website and/or the submission of a request. With reference to Article 13, paragraph 1, letter (d) of the Italian Privacy Code and Article 13, paragraph 1, letter (e) of the EU Regulation, the following entities may become aware of the user’s personal data in their capacity as data processors or authorized personnel: judicial authorities, tax offices, professionals and consultants, accounting firms for the processing of fiscal accounts, company employees, credit institutions, commercial information and debt collection companies, carriers, and employees and/or collaborators of the company specifically appointed in writing by the Data Controller and provided with specific instructions for the processing of the data.

Fulfillment of the data subject’s requests; Compliance with tax laws.
Transfer of Data Outside the European Economic Area (EEA)
Within the scope of the Company’s contractual relationships, Data may be transferred outside the territory of the European Economic Area (EEA), including through their inclusion in databases managed by third-party companies operating on behalf of the Company. The management of the databases and the processing of the Data are bound to the purposes for which they were collected and are carried out in full compliance with applicable data protection laws. Whenever Data is transferred outside the EEA, the Company will adopt all appropriate and necessary contractual measures to ensure an adequate level of Data protection, including, among others, agreements based on the standard contractual clauses for data transfers outside the EEA approved by the European Commission.
Data Retention Period
The data will be retained in accordance with applicable laws.
Data processed to provide the Service and for Customer Satisfaction purposes will be retained by the Company for the period deemed strictly necessary to achieve these purposes. Additionally, Data processed to provide the Service may be retained for a longer period in order to manage any disputes related to the provision of the Service. Data processed for Marketing and Profiling purposes will be retained by the Company from the moment the data subject provides consent until such consent is revoked. If consent is revoked, the Data can no longer be processed for the aforementioned Marketing and Profiling purposes but may still be retained to manage any disputes and/or litigation and/or to ensure the Customer’s security. The retention period for Data for Marketing and Profiling purposes established by ATS Europe S.r.l. complies with local regulations as well as the provisions of the Italian Data Protection Authority.
Data Subject Rights
The data subject is granted the following rights:
Right of access: the right to obtain from the Company confirmation as to whether or not personal data is being processed and, if so, to access such data;
Right to rectification and erasure: the right to obtain the correction of inaccurate data and/or the completion of incomplete data, or the deletion of data for legitimate reasons;
Right to restriction of processing: the right to request the suspension of processing when legitimate reasons exist;
Right to data portability: the right to receive the data in a structured, commonly used, and machine-readable format, as well as the right to transmit the data to another data controller;
Right to object: the right to object to the processing of data when legitimate reasons exist, including processing for marketing and profiling purposes, if applicable;
Right to lodge a complaint with the competent data protection authority in case of unlawful data processing.
